Staff Analysis of the Legislation

HB 883 amends §19-13-3 of the O.C.G.A., relating to the filing of a petition seeking relief from family violence. It clarifies the effect and length of effectiveness of temporary ex parte orders by stating that if a court issues an ex parte order, it shall remain in effect until the court issues an order dismissing such order or a hearing, whichever occurs first. It also changes the maximum number of days that a hearing must be held after the filing of the petition from 30 to 45.
